Qualified electronic signature

A qualified electronic signature is a modern and legally valid way of electronically signing documents. It is a digital form of signature that is equivalent to a classic handwritten signature on paper. Qualified electronic signature aims to increase the efficiency of processes, simplify them and at the same time ensure their trustworthiness.

How does a qualified electronic signature work?

A qualified electronic signature uses modern encryption and certification technologies to ensure the authenticity and integrity of the signed document. The basic elements of a qualified electronic signature are:

Personal identification

Before obtaining a qualified electronic signature, the user must go through an identification process. This includes verification of identity through personal documents, through other trusted identity such as bank or state-guaranteed identity, or through remote identification. Remote identification, however, is not uniformly anchored in the European market, leading to different legal interpretations and approaches.

Certification of authority

The qualified electronic signature is obtained from a trusted certification authority. This authority confirms that a given key belongs to a specific person on the basis of personal identification.

Cryptography

The electronic signature is based on asymmetric cryptography and Private Key Infrastructure (PKI). It uses a pair of keys - a private key (which the signer uses to sign) and a public key (which anyone can use to verify the signature).

Legal validity of a qualified electronic signature

In the European Union, the Regulation on Electronic Identification and Trust Services (eIDAS) is in force, which sets out the legal framework for qualified electronic signatures. Under eIDAS, a qualified electronic signature has the same legal value as a handwritten signature.

International recognition

Many countries outside the EU recognise and accept qualified electronic signatures as a legitimate means of signing documents.

Advantages of a qualified electronic signature

Efficiency

Faster and more convenient than manual signing.
The ability to perform legal transactions remotely without legal risks.

Responsibility

Each signature is assigned to a specific person who bears full legal responsibility for the signature, as with a handwritten signature on paper.

Demonstrability

Trusted providers guarantee the security of the entire process and the subsequent provability of ownership and validity of individual signatures.

A qualified electronic signature is a modern and secure way of legally valid signing of documents, which facilitates business processes and saves time and costs associated with traditional paper signatures.
